In your response you have brought out that threre has been no caselaw on “uplink”, origin and the questions of REtransmission. There actually has been. One in Estonia, as well as Latvia regarding Viasat (part og MTG Group), where the collective societies filed for renumeration regarding satellite broadcasting under the directive in all countries (footprint-countries).
In Estonia, after years of litigation the judgement is in favour of Viasat, but in Latvia it is not so.
